Categorizing Your Disability to Determine Compensation

The types of disability benefits under the Kentucky Workers' Compensation laws are broken down into three categories and determine how long you will receive compensation for your on-the-job injury. The categories are:

  • Temporary Total Disability. Your work-related injury forces you to be off work for a limited period of time for the treatment. When your doctor clears you to return to work or you've reached maximum medical improvement, these benefits are no longer paid.
  • Permanent Partial Disability. You may have recovered from your work-related injury to a point that allows you to return to work but you still have some impairment. Your body is not 100% recovered to the point it was prior to the injury and may never be. Payment of a percentage of benefits continues even after you return to work.
  • Permanent Total Disability. You are unable to return to work at all due to your work-related injury. You are unable to do the work you were previously doing nor are you able to be trained to do other work. The benefits paid to you depend on your age, education, average weekly wage at the time of injury and restrictions on former work.
